The Barham Park Trust is seeking to vary or discharge restrictive covenants at 776 and 778 Harrow Road. The decision, made by the Barham Park Trust Committee on Tuesday, September 8, 2026, follows a period where the owner of the properties had withdrawn an initial redevelopment proposal.
The committee approved the variation or discharge of these covenants, which are related to a development previously approved under planning permission 26/0196. The 'alterations and extensions' approved under this permission include the erection of an additional floor with projecting gables, alterations to fenestration, two-storey side and rear extensions, installation of cladding to all elevations, two rooflights and solar panels on the roof, associated hard and soft landscaping, new boundary treatment, and refuse storage to the dwellinghouses.

This approval is contingent upon obtaining up-to-date advice from an independent designated adviser and agreeing on appropriate financial and other terms that are in the best interests of the Trust. The role of the independent designated adviser is to provide up-to-date advice on the value and implications of any proposed variation or discharge of the restrictive covenants, which will inform the Trust's decision and any Heads of Terms.

Authority has been delegated to the Interim Director of Property and Assets, in consultation with the Chair and the Council's legal advisers, to finalise these terms. These terms must be consistent with the independent advice obtained and considered to be in the best interests of the Trust.
