Waltham Forest Council's Planning Committee has approved plans for a shopfront at 41 Orford Road, despite concerns raised by residents regarding potential noise pollution.

The committee granted permission for the installation of a ventilation duct to the rear, painting of the shopfront, and new signage. The application had been called in by ward councillors due to public objections concerning residential amenity from noise, smoke, odour, and wider air quality concerns.

The property at 41 Orford Road is in lawful use as a restaurant (Class E). The operations of a restaurant business necessitate the installation of an extraction system, which is the source of the potential noise, smoke, and odour concerns.

A report presented to the committee concluded that the proposed flue location was the least harmful option. This determination considered several factors, including urban design and heritage, with the chosen location being described as the least visible option and one that protects the character of the wider area, including heritage assets. Environmental Health officers were consulted and raised no objection, subject to compliance with conditions. The location was also assessed in relation to its potential impact on neighbouring occupiers.

To manage noise and odour impacts, the planning permission was granted subject to several specific conditions. These include:

  • Condition 4: The extraction system must be correctly installed, operated, maintained, and regularly serviced in accordance with the manufacturer's instructions, as specified in the noise impact assessment (issue 01, dated 25th November 2025) and the odour management plan and ventilation impact statement.
  • Condition 5: Within three months of the kitchen extraction system's installation, an assessment report confirming compliance with the noise impact assessment must be submitted to and approved by the Local Planning Authority. These approved details must be retained for the lifetime of the development.
  • Condition 6: Similarly, within three months of the system's installation, an assessment report detailing compliance with the odour management plan and ventilation impact statement must be submitted to and approved by the Local Planning Authority, and retained for the development's lifetime.
  • Condition 37: Noise from all new building services plant must be controlled to a level not exceeding 10dB(A) below the typical underlying background noise level (LA90) during plant operation, measured one metre external to the nearest noise-sensitive premises. This assessment must be completed in accordance with BS4142:2014+A1:2019.
  • Condition 38: Prior to the commencement of development, a sound insulation scheme must be submitted to and approved in writing by the Local Planning Authority. This scheme will detail the sound insulation to be installed between the commercial premises and residential premises to manage noise and disturbance.

Councillor Liz Biggs chaired the meeting, where seven planning applications were discussed, all of which were granted permission subject to conditions and informatives. These can be found in the Public reports pack and Decisions documents.

Should the development fail to comply with the relevant conditions or guidance, residents are assured that the Council has powers to enforce, whether from a planning or environmental health perspective. Objectors can report any issues to the Council, who will then exercise their enforcement powers.
