Waltham Forest Council's Planning Committee has deferred a decision on the retention of a single-storey rear garden outbuilding, described as a gym/home office, at 118 Vansittart Road, Forest Gate. The committee, which met on Tuesday, 8 September 2026, decided to defer the application for further consideration following a Councillor call-in and a significant number of objections from local residents.

Concerns raised by objectors included alleged discrepancies in the application form, the visibility of the building from Dames Road, and its height and potential impact on sunlight and daylight. The meeting information notes that officers received seven objection letters detailing these concerns.
Discrepancies in Application and Visibility
Objectors highlighted several discrepancies within the application form. They noted that the application incorrectly described both the existing and proposed roof as tiled, whereas the original structure reportedly had a flat felt roof. This led to the argument that the proposed gabled roof represents a significant increase in height, bulk, and visual prominence. Furthermore, objectors disputed the application's assertion that the development would not be visible from a public road or footpath, stating that the structure is clearly visible from Dames Road.
Council officers acknowledged these concerns but stated they were satisfied with the information provided to assess the proposal. They responded that having reviewed the submitted plans and supporting documentation, officers are satisfied that sufficient information has been provided to enable a full and robust assessment of the proposal.
They considered that the matters identified by objectors were either not material to the determination of the application or did not prejudice the Council's ability to assess the development against relevant planning policies.
Height, Sunlight, and Daylight Impact
Concerns were also raised about the outbuilding's excessive height significant loss of sunlight and daylight to rear garden.
While officers acknowledged that the development might result in some additional overshadowing, they concluded that any impact would be limited primarily to the rear portions of neighbouring gardens and would not significantly affect their overall usability or enjoyment. They stated that, given the site's context, the degree of overshadowing is not considered unreasonably harmful to neighbouring occupants.

The Residential Alterations and Retrofit SPD (2026) advises that outbuildings adjacent to boundaries should not exceed 2.5m in height. The outbuilding at 118 Vansittart Road has a maximum height of 3.6m, exceeding this guidance. However, the report notes this is mitigated by a mono-pitched roof form, which reduces perceived bulk and massing. Its siting to the rear of the garden also limits its visibility and ensures it does not appear unduly dominant or visually intrusive.
On balance, the report concluded that the increased ridge height does not give rise to a level of harm that would warrant refusal of the application.
Other Resident Concerns
Beyond visibility, height, and sunlight/daylight impact, other primary concerns raised by objectors included:
- The presence of trees on neighbouring land not being identified in the application.
- Objectors feeling that neighbour notification letters were not sent correctly.
- Concerns that the proposal would lead to overdevelopment of the site.
- The argument that allowing this outbuilding could set a bad precedent and have an adverse cumulative impact, although the council's response was that each case is determined on its own merits.
- A concern about the loss of light to plants, which was deemed not to be a planning issue.
Current Legal Status
While the decision is deferred for further consideration, the legal status of the outbuilding remains uncertain. An enforcement case was opened on 17 November 2025 for Without planning permission, construction of single storey outbuilding,
which is currently under investigation. This implies that potential enforcement action is pending.
